Peruvian Farmer Initiates Landmark Lawsuit Against RWE for Climate Change Impact

In a groundbreaking climate case initiated in Hamm, Germany, Peruvian farmer Saúl Luciano Lliuya is suing German energy company RWE for its contribution to climate change. Lliuya, supported by the climate organization Germanwatch, contends that climate warming has accelerated the melting of the Palcaraju Glacier near his home in Huaraz, thereby heightening the risk of flooding in the area. To safeguard his agricultural endeavors, which include corn, wheat, barley, and potatoes, he is pursuing $3.5 million to fund a flood control project.
RWE is reported to contribute less than 0.5 percent of global carbon emissions, predominantly from its coal production. Lliuya’s lawsuit posits that, in recognition of this level of responsibility, RWE should allocate approximately $18,500 towards flood mitigation initiatives. A study conducted in 2021 corroborated that climate warming is indeed linked with the glacier’s retreat, increasing flood risks in Huaraz. The study, led by Rupert Stuart-Smith from the University of Oxford, underscored a direct correlation between emissions and the urgency for flood protection.
While RWE is transitioning away from coal-powered plants, the company contends that individual entities should not bear sole responsibility for climate change. In its defense, RWE stated, “If such a claim were to exist under German law, it would also be possible to hold every motorist liable.”
Initially, a court in Essen, Germany, rejected the lawsuit, but it has since gained traction in a regional court in Hamm. A favorable outcome for Lliuya could establish a significant precedent, according to Seb Duyck from the Center for International Climate Law, indicating that this case might influence future claims against climate polluters globally as affected communities seek accountability and compensation for the impacts of climate change.
